The Tyranny of an Out of Control Justice System

Well I just learned of this today, Matt Bandy. Here is a 16 year old kid who was on the verge of being labeled a sex-offender for the rest of his life.

Think of this for a moment for all if you who have a computer in your house and just surf the web. You too can end up like Matt. Poor Matt, surfed the web and picked up little programs, generally termed spyware, that effectively took control of his computer. One (or more) of these spyware downloaded some porn, and child porn at that, to his computer. The police tracked the child porn to the family house and Matt’s computer had all these nasty little pictures on it.

Okay, child porn is bad and should not be allowed to exist. Those who take the pictures and purchase the pictures should be shot. However, Ward and June’s computer that has been infected by spyware that is storing child porn on the hard drive should not be convicted of anything other then gross incompetence on a computer.

I will say this . . . if you are going to purchase a computer for the home buy a Macintosh or a Linux machine. If you purchase a wintel based machine you are asking for trouble.

This child found himself in a nightmare from spyware. He was on edge of being convicted when 20/20 came to the rescue. Matt was convicted of showing a Playboy to his friends. I will admit I am glad for the statue of limitations.

I would hope that the governor of Arizona or George Bush will pardon this poor kid as well the teacher from CT. Arizona and other states please provide some training for police in how computers actually work.

Teacher Jailed for Computer Use

A teacher is found guilty of giving porn to several students at a school. This teacher has already been found guilty and is now facing 40 years in jail.

Here is the case: A sub teacher was supervising a class. Some students, about 10, saw a pop-up from the computer.

The teacher asked for help form administration, other teachers, and others. The school did not have an active filtering system for porn of pop-ups. The police testified that she acted with some sort of malice when she visited a site and spyware/ virus was introduced to the computer.

As we all know pop-ups are a fact of life of computer in particular when it comes to Windows based computers. This case is made worse by the neglect of the school board, the principal, and the IT department.

The internet filtering was not working because the license had expired. Who is responsible?

The IT department for either A) not cutting the internet when spyware and porn could get through; or B) for not updating the filter; or or C) providing sub-standard computers that are easily infected with spyware and virus.

The principal for not A) not cutting the internet when spyware and porn could get through; or B) for not providing the money for the filter; or C) not providing any training for this poor sub; or D) providing sub-standard computers that are easily infected with spyware and virus.

The School Board for A) not cutting the internet when spyware and porn could get through; or B) for not providing the money for the filter; or C) not making sure porn and spyware can get through; or D)providing sub-standard computers that are easily infected with spyware and virus.

The incompetence of the judge.
The incompetence of the prosecutor.
The incompetence of the police.
The incompetence of the jury.

The four combine for an axis of evil that conspire to incarcerate a woman for doing the best she can under the situation.

The effects on education will be tragic. No longer can teachers trust the internet in the classroom (esp. when a windows based computer is used). Teachers are now held liable for the actions of others.

Why should a teacher risk: jail, fines, loss of job, or loss of license and allow student to use the computer in the classroom.

Say good-bye to computers in the classroom.
